Distance Sales Agreement

This agreement is formed between the Seller and the Buyer for orders placed through skortabelasi.com. By confirming your order you declare that you have read and accepted it.

This is a translation provided for convenience. The sale is governed by Turkish law and the Turkish text prevails in the event of any discrepancy.

Article 1 — Parties

1.2. Buyer

The person who provides their name, address, phone number and e-mail on the order form and confirms the order. These details are taken as declared by the Buyer; the Buyer is responsible for delays and costs arising from an incorrect or incomplete declaration.

Article 2 — Subject

The subject of this agreement is the sale and delivery of the products ordered electronically by the Buyer through skortabelasi.com, whose characteristics and sale price are stated below and in the order summary, and the determination of the parties’ rights and obligations under Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation.

Article 3 — Products, price and payment

The essential characteristics of the products are published on the shop page. Current sale prices:

Listed prices are sale prices including all taxes and remain valid until updated. Shipping costs, if any, are shown as a separate line at checkout and added to the total. The total the Buyer will pay is shown clearly in the order summary before the order is confirmed.

Payment is collected by credit or debit card through the infrastructure of PayTR Ödeme ve Elektronik Para Hizmetleri A.Ş., a licensed payment institution. Card details are transmitted directly to the payment institution; the Seller neither sees nor stores them. If payment is not approved, no contract is deemed to have been formed.

Article 4 — Delivery

The product is delivered by carrier to the address given by the Buyer. Shipping is 89,00 ₺. Orders of 1.000,00 ₺ and above ship free. Orders are handed to the carrier within 2 business days. We ship with Aras.

The delivery period starts when the order and payment are approved and may not in any case exceed 30 days. If the Seller cannot perform within that period, the Buyer is informed and may terminate the contract, in which case the full amount paid is refunded within 14 days at the latest.

Delivery may take longer in areas the carrier serves only once a week, in extreme weather, or where roads are closed; the Buyer is informed in such cases. We ship within Türkiye only.

The Buyer must inspect the product on delivery and, if the parcel is damaged, refuse it and have the carrier draw up a damage report. Claims for damaged parcels accepted without such a report may not be met (see Delivery & Shipping).

Article 5 — Right of withdrawal

The Buyer may withdraw from the contract within 14 (fourteen) days of receiving the product, without giving any reason and without paying a penalty. Written notice sent within that period to [email protected] is sufficient.

The Seller refunds the price of the product and any delivery costs to the payment method used by the Buyer within 14 days of receiving the withdrawal notice.

The Buyer sends the product, with its invoice and all accessories, to the return address within 10 days of giving notice. Return shipping is at the Seller’s expense; no charge is made to the Buyer where the return is sent with the contracted carrier named on the Cancellation & Returns page.

Opening the packaging does not by itself cancel the right of withdrawal. The Buyer is, however, liable for any loss in value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product.

Article 6 — Where the right of withdrawal does not apply

The exceptions listed in Article 15 of the Distance Contracts Regulation are reserved. The Seller declares that the products sold under this agreement do not fall within those exceptions and are therefore all subject to the right of withdrawal.

Article 7 — Defective goods

If the product delivered is defective, the Buyer may exercise the remedies in Article 11 of Law no. 6502: termination of the contract, a price reduction, free repair, or replacement with a non-defective equivalent. Shipping and repair costs are borne by the Seller.

Article 8 — Default

Where payment is made by credit card and the bank fails to pay for a reason attributable to the Buyer, the Buyer is deemed to be in default and is liable for the Seller’s resulting losses. If the Seller fails to perform, the Buyer may terminate the contract and claim a refund of the amount paid.

Article 9 — Personal data

Personal data provided by the Buyer during the order is processed under Turkish Personal Data Protection Law no. 6698 solely to perform, deliver and invoice the order, to communicate about it, and to meet statutory record-keeping obligations. See the Privacy Policy.

Article 10 — Disputes and competent authority

For disputes arising from this agreement, the Consumer Arbitration Committees at the Buyer’s or the Seller’s place of residence have jurisdiction within the monetary thresholds announced by the Turkish Ministry of Trade, and the Consumer Courts above those thresholds.

Article 11 — Entry into force

By placing an order the Buyer accepts that they have read and been informed of all the terms of this agreement and of the Preliminary Information Form, and have approved them electronically. The agreement enters into force when the order is confirmed by the Seller, and a copy is sent to the Buyer by e-mail.
